A soil protection plan must be prepared for recultivation and recycling that allows for agricultural use:
For areas affected by interventions with a total area of more than 400 m², or
In the case of laying linear facilities exceeding 500 meters, involving the disturbance of the soil surface, or
For areas that have been damaged due to interventions other than agricultural use and will be used for agricultural purposes again after reclamation works.
The soil protection plan summarizes the expected damage caused by the activity, defines the purpose of the reclamation, the necessary work operations during the reclamation, their sequence, the necessary agrotechnical interventions, the thicknesses of the humus-rich layer worth saving, and contains a proposal for the possible placement of the subsoil that may be released. The soil protection plan is an annex to the "Application for a permit for the temporary use of agricultural land for other purposes" and the "Application for approval of a reclamation plan for land taken out of cultivation".
A soil protection plan must be prepared for the rescue of the humus-rich topsoil:
For activities with an area of more than 1,000 m² involving a permanent change in the soil level, which do not qualify as an investment,
For the rescue of the humus-rich topsoil during the implementation of investments requiring an area of more than 400 m².
In the above cases, the soil protection plan is a mandatory annex to the "Application for a permit for the inclusion of agricultural land in the built-up area" and the "Application for a permit for the permanent use of agricultural land for other purposes".

To determine the quantity and method of use of the humus-rich soil to be removed
To establish a humus management plan, which includes a plan of the works related to the removal, rescue, utilization of the humus-rich topsoil, and the restoration of the area.
